Living in the EU? There is another route

If you live in the EU and Instagram refused your appeal, the Digital Services Act gives you an out-of-court route. How it works.

Updated

Short answer. Under the Digital Services Act, people in the EU can take an Instagram moderation decision to a certified out-of-court dispute settlement body, such as Appeals Centre Europe, after using Instagram's own appeal. The body's decision is not binding on Meta, but Meta has to engage with it in good faith.

Before you use it

Appeal through Instagram first.

What it can and cannot do

It can review whether the decision followed Instagram's rules.

Outside the EU

The UK, US, Canada, Australia and the Gulf do not have this route.

Before you use it

  1. Appeal through Instagram first.
  2. Keep the notice and the refusal, with dates.
  3. Have the username and the email on the account ready.

What it can and cannot do

It can review whether the decision followed Instagram's rules. It cannot hand you the account back itself. A fee may apply to the platform, not usually to you; check the body's current terms.

Outside the EU

The UK, US, Canada, Australia and the Gulf do not have this route. See what is left with no appeal button.

What to do first

Here is the fuller version, step by step.

  1. Open the Instagram app on the phone you normally use and read the full notice, including any date shown.
  2. If there is a 'Disagree with decision' or appeal button, use it once and finish every step it asks for.
  3. Check Settings, then Account Status, for the post or rule involved when you can still log in.
  4. If someone else changed your login, look for the email from security@mail.instagram.com and use its link to undo the change, then go to instagram.com/hacked.
  5. Answer any selfie or ID request in good light, with no filters, glasses or hat.

Notes for European Union

Under the Digital Services Act you can take a final moderation decision to a certified out-of-court dispute body, such as Appeals Centre Europe. Save the final decision screen first.

How it works with Ban Help

  1. Message us on WhatsApp or email with the username and a screenshot of the notice.
  2. We tell you honestly whether this is something we can help with. Terms are agreed with you before any work starts.
  3. We prepare the appeal and the supporting details, to go through the platform’s own channels.
  4. We stay in touch while you wait. The platform makes the final decision, and nobody can promise the outcome.

QUICK ANSWERS

Good to know.

Do I need a lawyer?

No. The bodies accept complaints from individuals.

How long does Instagram take to decide?

Instagram does not publish a fixed time. Some decisions come back the same day, others take weeks.

Can I appeal more than once?

Usually the app gives one appeal per decision. Sending more does not tend to help.

Will I lose my followers?

If the account is restored, it normally comes back with its followers and posts.

Do I need Meta Verified to get help?

No. Meta Verified adds chat and email support for active subscribers, but appeals and the hacked page are open to everyone.
